Privacy notice for video surveillance (CCTV)

Guidelines on the data collected in accordance with Art. 12, 13 of the Data Protection Regulation (DSGVO) by Genesis Motor Deutschland GmbH via the video surveillance (CCTV) at the Genesis Studios.

This privacy notice informs you about how we process your personal data collected via our video surveillance and which rights and claims you are entitled to in your capacity as the data subject.

2. Purpose and legal basis of data processing

We process personal data for the purpose of safeguarding the legitimate interests of those responsible, and especially to enable the prevention, investigation and solving of criminal offences, the preservation of evidence/proof of criminal offences, the spotting of unauthorised access, the exercise of domiciliary rights and the assertion of claims under civil law. They also serve to protect employees, customers and other visitors.

The legal basis is Art. 6 (1)(f) GDPR.

3. Legitimate interests pursued (Art. 6 (1)(f) GDPR)

We process the aforementioned personal data to avoid and protect ourselves against criminal offences, arson, theft, vandalism and trespassing, as well as to protect our property, our employees, our customers and our visitors, and secure our buildings and facilities.

4. Data recipients or categories of data recipients

Should the recording contain a criminal offence, the aforementioned personal data is processed and transmitted to the police. In all other cases, a transfer to public bodies will only take place upon request and within the scope of the legal powers of the requesting public body.

5. Data storage periods

The video surveillance recordings are generally stored for 72 hours before being automatically deleted and only accessed if warranted (e.g. break-in at the Genesis Studio). Should video surveillance recordings be stored as evidence in a criminal or civil prosecution, they will be deleted in accordance with the statutory limitation periods.

6. Data transfer to a third-party country or international organisation

No data is transferred to third countries (countries outside the European Economic Area – EEA).

7. Notes on the rights of data subjects

Every data subject has the right of access under Art. 15 GDPR, the right to rectification under Art. 16 GDPR, the right to erasure under Art. 17 GDPR, the right to restriction of processing under Art. 18 GDPR and the right to data portability under Art. 20 GDPR. Regarding the right of access and the right to erasure, the restrictions according to §§ 34 and 35 BDSG apply. Furthermore, every subject has the right of appeal to a data protection supervisory authority (Art. 77 DSGVO in conjunction with § 19 BDSG).

8. Right to object under Art. 21 DSGVO

You have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (f) of Art. 6(1). If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or serve the establishment, exercise or defence of legal claims. The objection can be made without formalities and should preferably be addressed to:
